Further details: We process your personal data for the following purposes:

  1. To respond to explicit requests from the data subject/user.

Promotional activities (optional provision of data and consent)

Summary: Sending commercial communications, newsletters, carrying out direct marketing, market analysis, etc., via automated means (e.g. text messages and chat, email, automated phone calls) and traditional means (e.g. post, phone calls with an operator).

Further details on Marketing: Subject to your express consent, we may send communications via both digital and non-digital means (i.e. traditional methods such as post and/or calls from an operator) for the purposes of monitoring the progress of customer relationships, as well as planning and carrying out analytical, strategic and operational marketing activities, and to provide information on commercial and promotional activities relating to goods and services connected to those for which the relationship was established and the contact request was submitted. This purpose may therefore be pursued for reasons beyond those strictly linked to the basic purposes, should you decide to give your consent (after reviewing the information provided here). Should you choose not to give your (optional) consent for the aforementioned purpose, the basis and resulting obligations of the relationship between our company and you will in no way be compromised or altered; any requests or enquiries made will still be dealt with in all cases. Your consent, should you choose to give it, will therefore be deemed valid for contact made both by traditional means and via digital channels (e.g. email, SMS, MMS, fax, automated calls, etc.). Should you wish at any time to exercise your right to object and/or withdraw your consent, you may do so separately and independently via any of the contact methods provided.

The interactions and information collected by this Application are, in all cases, subject to the User’s privacy settings for each social network. Where a social media interaction service is installed, it is possible that, even if Users do not use the service, it may still collect traffic data relating to the pages on which it is installed.

Profiling (optional data provision and consent)

Summary: Profiling mechanisms may be used to create a personalised profile for you, based on the preferences and tastes you have expressed, and to ensure you receive advertising messages consistent with your profile. In this way, any advertising messages you may receive will be of greater interest to you. As required by current data protection legislation, prior consent – which may be withdrawn at any time – is required in order to carry out this activity.

Further information: With regard to the activity in question, please note that automated profiling of users (generally natural persons) may be carried out for the purpose of analysing or predicting aspects relating to professional performance, financial situation, health, personal preferences or interests, reliability or behaviour, the location and movements of the data subject, to the extent that this enables a profile of the data subject to be drawn up, leading to actions directed at you that are primarily promotional and targeted. Primarily, we may analyse and create a personalised profile for you, based on the preferences and tastes you have expressed whilst browsing and entering data on the Tecniwork website, and send you advertising messages consistent with your profile. In this way, any advertising messages, communications, notifications, etc. that you may receive will be of greater interest to you. As required by current data protection legislation, your prior consent – which may be withdrawn at any time – is required in order to carry out this activity.

Further details:

  • Use of audio and video recordings: Should you grant your specific authorisation as specified above, personal data (in this case: video recordings, photographs and audio recordings taken at events, trade fairs, conferences, etc.) will be collected and processed solely for the purpose of creating and producing promotional and representative material for the organisation, always in compliance with the restrictions and regulatory requirements in force.
  • Consent to inclusion on the map of retail outlets: If you meet the conditions and wish to include your retail outlet on the map, our role will be to publish the details you have provided on the website so that the public can locate your business as easily and quickly as possible.

Further details: Personal Data (e.g. email address, postal address, first name, surname and/or company name, names of contact persons, cookies, usage data, etc.) may be provided voluntarily by the User, or collected automatically whilst using this Application.

Any use of cookies – or other tracking tools – by this Application or by third-party service providers, unless otherwise specified, is intended to identify the User and record their preferences for purposes strictly related to the provision of the service or information requested by the User.

Failure by the User to provide certain Personal Data may prevent this Application and the undersigned company from providing their services. Please refer to the cookie policy for further details.

The User assumes responsibility for any third-party Personal Data published or shared via this Website and guarantees that they have the right to communicate or disclose such data, thereby releasing the Data Controller from any liability towards third parties.

6. Methods of data processing

Summary: Paper-based and computerised.

Further details: The processing of your personal data is carried out using manual and automated means, in a manner strictly related to the purposes set out herein and, in any event, in such a way as to ensure the security and confidentiality of your data. Should you wish to obtain further information, we remind you of the rights guaranteed to you as specified herein.

7. When is the user obliged to provide us with their personal data?

Summary: Basic purposes: mandatory. Other purposes (marketing/promotional activities/audio-video recordings/inclusion of shop location maps): optional.

Further details: The types of personal data collected and processed on the website www.tecniwork.it are those necessary for the provision of the requested services; in all other cases, they are derived from the user’s browsing activity. It is therefore clear that, should such data not be provided, we will be unable to provide you with the services that require the use of these tools. Should you not give your consent to receiving advertising, direct marketing or interactive commercial communications, your email address and telephone number will not be used for this purpose.

Please note:

  • Any voluntary sending of emails to the addresses indicated on the website entails the collection of the sender’s email address as well as any other information contained in the message; such personal data will be used solely for the purpose of performing the service or task requested.
  • The optional provision of data via the forms on the Website (newsletter, contact form, etc.), as well as the optional, explicit and voluntary submission of data via web forms or by email to the addresses indicated on this Website, for the purpose of obtaining specific services and/or communications and information, entails the subsequent collection of the sender’s address/contact details, which are necessary to respond to enquiries or to provide the requested services, communications and information, as well as any other personal data entered.

8. Protection of minors

Summary: The processing of minors’ personal data may take place provided that consent is given or authorised by the person with parental responsibility.

Further details: Tecniwork does not intentionally collect personal information (such as name, address and telephone number, etc.) from minors. We do not allow minors to register on our websites or to take part in online competitions or promotions. In any event, if the parent or guardian of a child believes that the child may nevertheless have provided personal information, they should contact us if they wish to have such information deleted from our records. Should Tecniwork become aware that it holds personal information relating to a child, it will immediately delete such information from its databases. Should any false information be provided, Tecniwork shall be held harmless from any liability and/or claim, without prejudice to the checks it undertakes to carry out. Furthermore, please note that all minors must, in any event, obtain the necessary authorisation from their parents or guardians before using or publishing information on websites of any kind.

9. Categories of recipients to whom personal data may be disclosed

Summary: Tecniwork employees and equivalent staff classified as ‘authorised data processors’ (administrative, sales and marketing staff, system administrators, etc.) who have been duly trained and supervised by the data controller; external parties (e.g. agents, legal and administrative advisers, experts in sector-specific regulations, technical service providers, hosting providers, IT service companies, communications agencies, business partners where necessary to fulfil specific obligations, etc.).

Further information: We will not disclose your data, this term meaning to make it known to unspecified parties in any way, including by making it available for consultation. In general, we may communicate your data – this term meaning to make it known to specified parties – under the following conditions:

  • To parties who may access the data pursuant to a provision of law, a regulation or EU legislation, within the limits set out in those provisions.
  • To parties who need to access the data for purposes strictly related to fulfilling your request and for ancillary purposes, within the limits strictly necessary for the related tasks (public security authorities and other public and private bodies for the fulfilment of legal obligations, including those of an administrative nature, and similar).
  • To company employees designated as authorised to process personal data and to staff responsible for responding correctly to your requests, limited to the communication requirements involved (this includes your name, email address and any other contact details you have provided).
  • To the operators of the corporate website who carry out, on our behalf, technical or organisational tasks essential to the provision of the requested services, as well as to any third parties involved in the activities in various capacities.
  • To parties who assist us in sending communications for commercial or promotional purposes.
  • To system administrators specifically appointed by the undersigned in accordance with regulatory requirements.

Please note: your data will not be disclosed to third parties for their marketing purposes.

10. Retention period for personal data

Summary: 10 years, renewable unless you withdraw your consent or exercise one or more of your rights.

Further details: Your personal data will be retained in our records for the purposes mentioned herein and on the basis of your consents for the period deemed appropriate, namely for a maximum of 10 years, renewable by tacit consent unless revoked or subject to other forms of necessary deletion due to internal or external changes. This period may be reduced and/or extended (subject to notification to the data subjects) in the event, for example, of instructions from institutions and/or supervisory authorities. You retain the right to withdraw your consent at any time without affecting the lawfulness of processing based on the consent given prior to such withdrawal.

11. Transfer to countries outside the EU

Summary: The data controller may transfer your data to countries outside the EU in order to use services such as data storage or to create mailing lists; naturally, in such cases, Tecniwork undertakes to verify the security of the transfer of personal data in accordance with the criteria established by the legislation (for example: the existence of a ‘legally binding instrument’ enforceable between public authorities or public bodies; binding corporate rules; standard data protection clauses adopted by the Commission; codes of conduct; certification mechanisms).

Further information: The transfer of personal data to countries outside the European Union may entail greater risks and, as such, must be adequately monitored; furthermore, it is a complex activity requiring specific expertise. An organisation’s starting point in this regard must be based on the adoption of safeguards designed to maintain the same level of protection that personal data would enjoy if it remained within the EU. Should Tecniwork make use of this option, it undertakes to collect in advance and make available to data subjects all supporting documentation (for example: the existence of a ‘legally binding instrument’ enforceable between public authorities or public bodies; binding corporate rules; standard data protection clauses adopted by the Commission; codes of conduct; certification mechanisms) in the same manner as in which rights may be exercised.

12. Complaints to the Data Protection Authority

The procedures available to you for your protection (in addition to exercising your rights against us) are:

  • Access via the website www.garanteprivacy.it, in the section specifically dedicated to complaints, where the Italian Data Protection Authority has jurisdiction.
  • By following the procedures laid down by the supervisory authority of the Member State (where different from Italy) in which the data subject habitually resides, works or where the alleged infringement took place.

13. Your rights

Summary: Access – Restriction – Rectification – Objection – Withdrawal of consent – Erasure (Right to be forgotten) – Data portability.

Further details:

  • Right of access: You may receive a copy of the personal data being processed at any time.
  • Right to restriction of processing: This may be exercised not only in the event of a breach of the conditions for lawful processing but also where you request the rectification of data or object to the processing; the Data Controller undertakes to mark the data in question during the period of its assessment of how to proceed, using organisational measures appropriate for this purpose.
  • Right to rectification: You may obtain the rectification of inaccurate personal data concerning you without delay and may also obtain the completion of incomplete personal data, including by providing a supplementary statement.
  • Right to object: You may object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you, even if used for direct marketing and/or profiling.
  • Right to withdraw consent: Where it has been given, for example for marketing and similar purposes.
  • Right to erasure (right to be forgotten): You may request the erasure of data in a more comprehensive manner, for example even after the data subject has withdrawn their consent to the processing of personal data.

The website provides a virtual assistant based on artificial intelligence to respond to enquiries regarding products, services and the use of the website. Conversations are processed solely for the purpose of providing a context-specific response to the enquiry made; they are not used to create a personalised user profile or for direct marketing purposes.

  • Legal basis: Implementation of pre-contractual/contractual measures and legitimate interest in the operation of the service (Article 6(1)(b) and (f) of the GDPR).
  • Retention: Conversations are retained for a maximum period of 90 days, after which they are anonymised.
  • Provider: The service utilises a third-party technology provider (OpenAI Ireland Ltd. / OpenAI OpCo LLC, USA) to process requests; the transfer of data to the United States is governed by the Standard Contractual Clauses approved by the European Commission.

The assistant does not provide medical diagnoses, treatment prescriptions, legal advice or specialist opinions. The database which the AI system draws upon to provide answers and information is owned by Tecniwork S.p.A.
